These terms and conditions apply to the use of this website and to the direct supply of Bluestone Yeast products and services arranged with Bluestone Yeast Pty Ltd.

Please read these Terms and Conditions carefully before placing an order or requesting a service. These Terms and Conditions contain important information about supply, delivery, returns, and limitations of liability.

Terms and conditions for BSY Products

These Terms and Conditions constitute a contract between the customer (you) and Bluestone Yeast.

1. Agreement

In these Terms and Conditions, we, our, or us means Bluestone Yeast; and you or your means the person or business that uses this website, contacts us, or orders products or services from us.

By browsing the website, contacting us, or placing an order, you agree to these Terms and Conditions. Any written quotation, invoice, order confirmation, or supply agreement forms part of the agreement between us.

The agreement cannot be varied unless we agree to vary it in writing or by email.

2. Legal Capacity

If you are under the age of eighteen (18) years you cannot place orders with Bluestone Yeast. By placing an order, you acknowledge that you are over the age of eighteen (18) years and have authority to order on behalf of the relevant business where applicable.

3. Website Use

The website may contain links to other websites. Those links are provided for convenience only and may not remain current or be maintained. We are not responsible for the content or privacy practices associated with linked websites.

You must ensure that your access to, or use of, the website is not illegal or prohibited by laws which apply to you.

You must take your own precautions to ensure that your process for accessing the website does not expose you to risk of viruses, malicious computer code, or other forms of interference which may damage your computer system. We take no responsibility for any such damage which may arise from your use of the website.

4. Pricing

Prices displayed or quoted by Bluestone Yeast are subject to change without notice until an order is accepted by us in writing. Once an order has been accepted, the price cannot be varied except by agreement between you and us in writing or by email.

Unless otherwise stated, prices exclude delivery costs, taxes, duties, and any other charges that may apply to a particular supply arrangement.

5. Product Specifications

Features and specifications of products described or depicted on the website are subject to change without notice. We will not materially change the agreed features and specifications of a product once an order has been accepted by us unless we agree that change with you.

All weights and dimensions of products described on the website are approximate. All screen images contained on the website are simulated unless otherwise indicated.

6. Orders

You may place an order by contacting Bluestone Yeast directly, responding to a written quotation, or following any ordering process we provide to you in writing.

Orders are only accepted once Bluestone Yeast confirms the order in writing or issues an invoice or order confirmation.

Bluestone Yeast will usually communicate with customers via email or phone. It is the customer's responsibility to provide correct contact details and to check correspondence relating to an order, delivery, or service request.

Bluestone Yeast reserves the right to decline an order or cancel an order at any time prior to dispatch or service delivery where we reasonably need to do so.

In the event of a cancelled order where payment has already been made, funds paid in relation to that order will be refunded in full unless otherwise agreed in writing.

Bluestone Yeast does not accept responsibility for orders or enquiries that are delayed or not received due to disruptions with internet, email, phone, or other communication services.

Bluestone Yeast shall not be liable for any delay in performing any of its obligations under this agreement if such delay is caused by circumstances beyond the reasonable control of Bluestone Yeast, and Bluestone Yeast shall be entitled to a reasonable extension of time for the performance of such obligations.

Where you have provided an incorrect or incomplete delivery address, we may charge a redelivery fee for each subsequent delivery attempt.

7. Payment

Payment terms will be set out in the relevant quotation, invoice, account terms, or written order confirmation.

Where payment is required before dispatch or service delivery, Bluestone Yeast may withhold supply until payment has cleared or other payment arrangements have been agreed in writing.

If a product or service is incorrectly priced or quoted due to an error, we may contact you to correct the error before accepting or fulfilling the order. If payment has already been made and you do not wish to proceed at the corrected price, we will refund the payment for that item or service.

8. Delivery and ownership of the goods

We try to ensure that all products are delivered in a prompt and timely manner. Freight, cold-chain logistics, courier availability, weather, and other factors outside our control may result in delays. Bluestone Yeast does not accept any liability for loss or damage suffered by anyone because of such delays, except where liability cannot be excluded by law.

Any dispatch or delivery date we provide is an estimate only unless expressly confirmed otherwise in writing. Where scheduled dispatch of a product is materially delayed, customers will be notified by email or phone.

Bluestone Yeast does not deliver products to PO Box addresses as a matter of course. We may be able to accommodate this in exceptional circumstances. Please contact us before placing an order if you need delivery to a PO Box.

We request Australian customers give an Authority to Leave (ATL) for products to be delivered without a signature, to avoid costly redelivery charges. In the unlikely event of theft or damage, a full investigation will take place and where appropriate a full refund or replacement dispatch will be made in accordance with our returns policy.

The couriers or postal services nominated by Bluestone Yeast will deliver products during local business hours, 9 am to 5 pm, Monday to Friday.

Bluestone Yeast is not responsible for the delivery times of products. Once products have been dispatched, it is the customer's responsibility to liaise with the nominated courier in relation to date and time of delivery.

Bluestone Yeast reserves the right not to ship to remote or rural locations or international countries where goods selected are known to be prohibited from import for customs, quarantine, or other regulatory reasons.

9. Faulty or damaged goods

Bluestone Yeast will repair, replace, or refund faulty or damaged products in accordance with the product warranty terms and conditions and your rights under the Australian Consumer Law.

10. Refunds and returns

Nothing in these Terms and Conditions excludes, restricts, or modifies the consumer guarantees provided for by statute including under the Australian Consumer Law.

All refunds may take up to 10 business days to be processed. Other than in accordance with the Returns Policy, refunds are strictly limited to those available under clauses implied by statute.

In order to facilitate a return under the Returns Policy, please contact us at info@bluestoneyeast.com.au. The customer must comply with directions from Bluestone Yeast staff to facilitate a return.

Returned products under the Returns Policy must be returned in their original packaging with all accessories and must be in a resaleable condition. Nothing in this clause limits or restricts your ability to make a claim that may be available to you for failure to comply with a guarantee under the Australian Consumer Law.

Subject to clause 10.8, it is the customer's responsibility to ensure returned items are returned safely. We take no responsibility for products lost in transit.

Where you are returning a product to us because of our failure to comply with a consumer guarantee, you must return the product to us at your cost unless the product cannot be returned, removed, or transported without significant cost to you because of the nature of our failure to comply with the consumer guarantee, or the size, height, or method of attachment of the product. If this applies, we will collect the product at our expense within a reasonable time.

11. Warranties

Nothing in these Terms and Conditions excludes the application of statutory conditions, warranties, and guarantees.

12. Liability

To the extent permitted by law, we will not be liable for any loss of income, loss of profits, loss of contracts, loss of data, or for any indirect or consequential loss or damage of any kind, whether caused by tort, breach of contract, or otherwise. Our maximum aggregate liability for any product supplied to you shall in no circumstances exceed the amount payable by you to us in respect of the product(s) in question.

Nothing in this clause limits or restricts your ability to make a claim that may be available to you for our failure to comply with a guarantee under the Australian Consumer Law.

13. Intellectual Property

All intellectual property in any material on the website is the property of Bluestone Yeast Pty Ltd. Unless expressly authorised under these Terms and Conditions or otherwise, you may not reproduce, adapt, modify, display, perform, or distribute any material or any part of any material.

14. Privacy

By placing an order or otherwise contacting Bluestone Yeast, you agree that we may store, process, and use information collected from you for the purposes of responding to your enquiry, supplying products or services, managing customer relationships, and providing you with information from time to time on other Bluestone Yeast products or services that may be of interest to you.

You may obtain a copy of the data held by us concerning you on written request. We reserve the right to charge an administration fee for processing such request. If any data held by us concerning you is incorrect, we will correct it on your written request. Please refer to our Privacy Policy.

15. Miscellaneous

Title and risk in Bluestone Yeast products pass to you at the point of dispatch or embarkation by Bluestone Yeast to your courier.

Bluestone Yeast reserves the right to make changes to the Bluestone Yeast website and these Terms and Conditions without notice. Any changes will operate prospectively from the time that the revised Terms and Conditions are published on the website and will not impact any purchase contracts entered prior to publication.

Any provision of these Terms and Conditions which is void or unenforceable may be severed without affecting the enforceability of other provisions.

A failure or delay by Bluestone Yeast to exercise a power or right under these Terms and Conditions does not operate as a waiver of that power or right.

Insofar as they apply to the supply and delivery of Bluestone Yeast products and services, these Terms and Conditions are governed by and must be construed according to the law of the State of Victoria, Australia and the parties submit to the jurisdiction of the courts of that state.

No Bluestone Yeast employee or agent has the authority to vary any of the Terms and Conditions governing any sale.
